Clause one
Social insurance contribution shares
Article no. 13
The hiring agency shall be committed to deduct 6% out of the monthly basic wage of the insured used for the calculation of old-age, disability, and death.
Article no. 14
Percentage of 6% for old-age, disability, and death and 1% for injury –during-work out of the total wage of employees of an agency, and senior directors shall be accountable for deduction of social insurance contributions accurately per this article and earlier article, or any other financial dues for the GASSP, and remittance of such to the Fund at the Central Bank of Yemen or its branches in governorates, and the CBY shall not disburse monthly wages and salaries cheques unless separate cheques of deducted contributions are attached.
Article no. 15
The hiring agency independent financially shall bear a fine of 2% out of the total due contribution or any other amounts for each month of remittance postponement to the Fund form the date of due until payments according to law provisions. For the administrative apparatuses of the State, a reference to Cabinet shall be made to issue directives in this regard.
Article no. 16
For amendments of social insurance contributions mentioned in article no. 13, 14 either increase or decrease ,except as provided by this bylaw, if necessary shall be made by a republican decree based on the Minister presentation and after Cabinet approval.
Article no. 17
It may be possible , after Minister presentation and Cabinet approval to impose social insurance contributions for old-age, disability, and death on allowances of the insured conditioned by the following:-
1- These allowances are constant and fixed.
2- Such allowances are connected to the insured personally and to the job occupied and deemed to be part of the basic wage when calculating pension.
Article no. 18
Contributions calculations shall be based on percentage defined in article no. 13,14 of this bylaw out of the total basic wage of the insured before making any deductions.
Article no. 19
The hiring agency commits to keep the GASSP informed by sending accredited monthly payrolls copies or wages differences as existed besides copies of remittance notices of due amounts for the GASSP's Fund at the Central Bank of Yemen or Al-Ahli Bank or their affiliated branches.
Article no. 20
The GASSP shall document payrolls copies sent to it by the hiring agencies and inspect implementation of law first by first in respect to contributions deductions and other amounts, and to compare these copies with Central Bank of Yemen's remittance notices of amounts actually remitted to the GASSP's Fund. The hiring agency(ies) that dose not respect implementation of provisions of the law totally or partially, penalties defined in law shall be implemented.
Clause two
Social insurance and pensions revenues and administrations
Article no. 21
Social insurance and pensions Fund shall replace social Funds with their revenues in terms of rights and obligations including, and the GASSP undertakes administration of this Fund.
The revenues of these Funds are:-
1- Contributions of both the hiring agency and the insured.
2- Amounts paid by the insureds to the account of actual or deemed service.
3- Capital value of social security Funds and amounts returned by from insurance companies.
4- Amounts paid by the public treasury for the account of earlier service of state's employees.
5- amount due paid by the hiring agency earlier defined according to earlier laws and bylaws or debts due for others.
6- Result of dividing monthly net wages, bonuses, awards, or allowances.
7- Aids or donations accepted by the board of directors.
8- Revenues proceeds.
