chapter four: Replacement regulation and rules for the insured or eligible pensioner

Article no. 50
The pensioner may request a replacement of a part of pension in light of provisions of Social Security Act or earlier Acts.

Article no. 51
Replaced part shall not exceed 1/4 of pension.

Article no. 52
Substitute period shall be five years ( 60) months.

Article no. 53

Substitutions shall be possible in the following cases:-

1- the marriage of the daughter or the son of the applicant of substitution.

2- sickness requires treatment abroad or for a long period of time in light of resolution made by the designated Medical Committee.

3- to build or restore a residence, or any other case deemed convincing by the GASSP.

Article no. 54

Substitution fees shall be 3% , and shall be deducted as a lump sum upon disbursement of substituted pension.

Article no. 55
Substitution application presentation and registration:-

1- substitution application shall be written on the formed prepared by the GASSP.

2- Substitution application shall be presented to branch from which pension is disbursed after completion of the upper part by applicant knowledge.

3-application and enclosures shall be submitted to substitution department in the Head Center or the main branch in Aden as applicable.

4- the concerned department shall record applications in records designed for such purpose according to date of receipt, and test documents and Medical Committee resolution in accordance to substitution application causes, and shall be submitted to the Division of Completion to confirm authenticity of employment data.

5- statements (list) of each accepted application shall be made indicating applicant's name, employer, prior salary, registration number, value of substituted capital, and the monthly deduction. This statement shall be presented to Chairman or Deputy Chairman for final approval.

Article no. 56
Substitution capital shall be valued in respect to schedule attached.

Article no. 57
The receipt of substitution application shall be made every three months provided disbursement shall be within the limits of the accredited balance and according to firstly received acceptable application:-
1- the applicant shall be notified by an official letter in which amount estimated shall be defined to obtain approval in accordance with schedule ( 2) Estimation Acceptance Acknowledgement.
2- the applicant signs the above mentioned form before the employee undertakes such at the Head Center or Aden branch , for other branches in governorate, the applicant sings before the G.M. of the branch who approves signature, stamps the application form , and signs the application.
3- if applicant refuses to sing Estimation Acceptance Acknowledgement, application cancelled.
4- disbursement of debt(substitution) shall be by a cheque registered of the fund of debts of the GASSP at the bank , and delivered to applicant personally with the notification of the G. M. of Finance at the Head Center or in Aden branch , or any other means deemed appropriate.

Article no. 59
The applicant shall not be entitled to request another debt(substitution) unless repayments of debt earlier owed are made.

Article no. 60
The substitution of application shall have no right to waive amount of debt to another person and debt (substitution) shall be disbursed to survivor(s).

Article no. 61
If pensioner whom requested debts dies, monthly deduction shall be made out of eligible survivor(s)'s pension, if there is no eligible survivor(s) , remaining due amount shall be deducted as one- off repayment assuming pensioner is still alive, and in case of re- entitlement for pension , repayment installment deduction shall be made.

Article no. 63
Debt disbursement shall be applicable for :-

First phase:- for pensions receivers.
Second phase :- for insured employees in light of provisions of this bylaw based on Board of Directors approval of application of this phase and percentage of debt.
