Clause one

Article no. 64

Injury- during – work compensation shall be financed by :-

1- monthly contributions committed by employers with rate of 1% out of the total wage of the insured employees subject to provisoions of this bylaw.
2- invested revenues proceeds and the insured employees shall not accrue any share according to such insurance.

Article no. 65
Injury- during- work integrates the following:-

1- injuries at work or during work within official work time or during the additional work time.

2- if injured during performing a duty in any governorate.

3- if injured during rescue missions against dangers or calamity threatening work ,or work safety.

4- injuries of marines , airlines employees , or marine tours employees during performing duty.

5- if injured abroad while being on an official mission or attending a training.

6- if employee or worker was subject to biochemical, chemical , or natural causes exist at work or due to nature of work.

7- road injuries in any of the following cases:-

- any accident takes place during going or returning to work provided that road is the daily normal road.

- road injury caused during giving assistance to road accident injuries in the normal road.
-- road injuries caused during going and returning from work in the unusual daily road if reasonable and practical justifications are presented.
- road injury abroad if is on an official mission.

Article no. 66
The GASSP is in charge of benefits of the insured's due benefits during one year as of the date of actual service end if disease symptoms are noticed caused by work or by the nature of work.

Article no. 67
Coverage suspends in the following:-

1- if the insured is working at any agency not subject to provisions of this law.

2- mandatory military service, recalled to serve the military.

3- periods of vacation, studying-related vacations, abroad scientific delegations.

Article no. 68
If insured is injured an actual injury , the employer or the hiring agency shall be assumed to take the following measures:-

1- primary medication be made( first aid) .

2- to undertake transportation of the injured to appropriate treatment facility.

3- to investigate injury causes by the hiring agency's medical committee indicating injury causes in details, confirming witnesses statements , and the injured explanation about the causes, if possible, provided that investigation illustrates if injury resulted due to a grave deliberate misconduct or not , and a copy be sent to the GASSP within a week maximum.

4- the hiring agency or the surrogate of the hiring agency undertaking investigation affirms witnesses statements , if injury happens at an agency under establishment and the hiring agency has no Medical Committee , the GASSP shall undertakes investigation if deemed necessary.

Article no. 69
The insured shall have to report to the hiring agency , or any police station about the injury causes and circumstances, as possible. The insured may report directly to the GASSP about the injury if the hiring agency is not responsive, and the GASSP shall undertakes injury investigation , and measures to refer the case to the medical committee be completed.

Article no. 70
The hiring agency shall be assumed to make the following when insured employee is injured:-

1- to inform the GASSP during a week after the injury , and the injured shall be notified by a copy of the notice in the approved form and accredited by the designated Medical Committee.

2- the hiring agency shall have to report police station about the every death, serious wounds or injuries causing inability of work or incident deemed a punishable crime during a week of the injuries or incident date except vocational occupational diseases. The police shall have to verify injury causes ,affirming injured statements, as attainable, indicating injury causes if might be caused due to deliberate misconduct, or a possible accountability lies on anther person.

3- the hiring agency shall have to report to the GASSP, and other occupational health and safety agencies about any symptoms of occupational disease , set forth in schedule (3),that insured employee may sustain form during performing duty during a week from discovering disease symptoms. The insured shall be notified by a notice according to form accredited. The insured may report about the occupational disease if the hiring agency is not responsive.

4- the hiring agency shall have to inform the GASSP the sick insured employee covers up and return to earlier work.

5- the hiring agency shall have to report to the GASSP about injuries happened out of the official work time within a period set out in schedule no. (1) of this law , and approved by the designated Occupational Health and Safety Medical Committee at the hiring agency.

Article no. 71
Insured examination

The hiring agency shall have to examine employees susceptible to any of the occupational disease set forth in schedule no. (3) at a periodic time or at any time necessitated by occupation health and safety circumstances at work.

Article no. 72
Injury report process

1- the hiring agency shall have to report to the GASSP about work injuries on the defined designated form by the GASSP, and notice of four copies shall be made, two copies for the GASSP, a copy for the Occupational Health and Safety Committee, and a copy for the hiring agency.

2- a ship captain or a plane undertakes notification of any injury sustained by crew during work accompanied by witnesses minutes of each case. The administration shall have to present the injury report to the GASSP supported by witnesses minutes.

3- the insured directly report to the GASSP about the injury shall have to record report statements.

4- if insured injured at considerable distance from work place, the GASSP and the hiring agency at nearest place shall have to be notified to make necessary procedures set forth in this article.

Article no. 73
1- the GASSP undertakes injury registration and complete procedures of compensation disbursement if a whole or partial disability is affirmed or death corresponding to disability assessment percentage according to the designated Medical Committee assessment.

2- the hiring agency shall have to make records to record injuries during work causes, circumstances, and compensation , and to take necessary measures leading to elimination of such injuries causes in light of conclusions made out of this record.

Article no. 74
To report injuries and record injury , it is conditioned :-

1- link existence between injury and causes , and injury happened during work or by work duties.

2- death during work due to normal deceases shall be integrated except cases when link of causes affirmed.

3- the hiring agency shall notify the GASSP of any injury within a week of injury.

Article no. 75

1- the hiring agency commits to coordinate with the GSSP to examine insured employee of any possible occupational injuries periodically as required.

2- the hiring agency shall participate and coordinate in such examination preparation and organization with the GASSP.

Article no. 76
1- the injured insured employee shall maintain obtained medical document ordinary, and submit these documents to the hiring agency whom shall refer such to the GASSP to assess disability percentage.

2- injured insured employee may maintain copies of medical documents needed to be presented to doctor provided the hiring agency is notified.

Article no. 77
The insured shall have to follow instructions set below if injured during work:-

1- to make appointment to see doctor(s) specialized within 15 days maximum from the date of injury or from the day of discovering occupational disease.

2- to follow instructions of the doctor(s)

3- to notify his/her doctor if moved to another area so as proper medication continues , and avoiding unexpected relapse.

4- to be honest before the supervising Medical Committee, and not to pretend to be sick.

Article no. 78
Vacation period for injuries be suspended and deemed normal vacation, and entitlement of cash compensation be suspended in any of the following below:-

1- if injured deliberately .

2- if injury causes are result of grave misconduct, cases deemed to be such:-
- all actions made under effect of drug, or being drunk.
- all violation of written and verbal health and safety instructions.

3- if injured insured goes to doctor after 15 days without reasonable justifications approved by the GASSP.

4- If injured person does not follow instruction during treatment.

5- if the injured travels abroad without prior notice to doctor(s) supervising treatment leading to unexpected relapse.

Clause two

Procedures of injury compensation disbursement

Article no. 79
1- the GASSP undertakes injured employee reference to the medical committee and assess injury percentage according to the following:-

- to have healed and returned to work , or realized to be incompetent for work.
- submission of all medical documents to the Medical Committee attached to the form of reference to the Medical Committee.
- the Medical Committee shall have to submit a report to the GASP or its branches.

Article no 80

Disability assessment shall be made by the Medical Committee.

Article no. 81

The GASSP shall make the calculation of compensation corresponding to disability assessment according to provisions of this entry.

Article no. 82
If service ends due to death or injury resulted in invalidity and affirmed to be eligible for cash compensation of YR 39.000, the amount be disbursed to insured or survivor(s)

 

Article no. 83
if injury caused permanent disability , the GASSP disburses lump sum compensation corresponding to disability percentage estimated out of the whole disability compensation as follows:-

Disability percentage multiplied by compensation standard YR 39000

Article no. 84

Each injury case, the GASSP shall make a file for to document the following:-

1- injury report sent by the hiring agency or he insured employee.

2-witnesses minutes , and injury investigation minutes indicating in detail injury causes and circumstances or a ploice report for serious injuries.

3- the Medial Committee report about the incident and its circumstances.

4- treatment received document.

5- a medical report about injury or death happened abroad.

6- returning- to –work report.

7- the Medical Committee report after view indicating disability percentage.
