Clause one
Article no. 85
The hiring agency shall have to send the retirement file to the GASSP or its branches before at least of six months in the following cases:-
1- if being referred to retirement due to being 60 years old for men and 55 for women .
2- if actual service is 30 years , and the file must integrate the following:-
a- a report about employment status for the insured in respect to date of retirement( service- end).
b- a report issued by the Ministry of Civil Service indicating appointment date , job description, basic wage, and date of birth.
c- the hiring party acknowledgement affirming that employee worked without suspension periods from date of employment to service- end date.
d- independent enumeration acknowledgment and changes of status for independents, and the GASSP respects statement acknowledgement according to provisions of article no. 38
e- service-end resolution indicating the exact date of service end.
f- indication of periods excluded due to unpaid special vacation, absence without permission, work suspension and wage was suspended, periods of service without making contributions, periods received for service –end award, or service abandonment indicating each period commencement and end.
g- periods of actual or normal service which are added and approved by the GASSP as requested by the insured's application after payment of due contributions according to provisions of this bylaw, if available.
h- resolution of the minister in charge to extend service period if being 60 years old and service period less than 15 years indicating date of birth , employment, period extended, provided that period extended shall not exceed 5 years , so as actual service period and extension be total of fifteen years , as existed.
Clause two
Documents required if insured dies
Article no. 86
For death cases, with taking into consideration provisions of earlier article , survivor(s) shall have to submit the following document to the hiring agency ,also attached with retirement file, service-end resolution to the GASSP:-
1- Death certificate or any other official document indicating death date and causes.
2- legal evidence issued by the court indicating independents of the deceased , relatives link status, marital status, job, and date of birth.
3- official notice of eligible survivors at any studying phase stating the deduction for studying and birth date based on student's file.
4- original copies of accredited birth document or age-defining document for eligible male survivor(s).
5- widows' marriage documents or any other accredited approved document issued by any official party .
6- designated medical committee resolution of invalidity of insured employee.
clause three
Documents required if insured injured abroad
Article no. 87
If insured is delegated on an official mission abroad and injured to extent of invalidity or death, the hiring agency shall have to enclose the following documents besides above- mentioned documents:-
1- The ministerial resolution in which such assignment, and assignment period are stated.
1- Report of injury notification and consequences.
3- The foreign country's police report stamped by embassy or consulate of Yemen.
4- Medical notice of the hospital to which injured was taken to and performed the first medical aid stamped by embassy of Yemen indicating date and hour of death, or serious injury caused partial or complete invalidity.
5- a document issued by the embassy of Yemen in which injury takes place indicating death or injury causes and circumstances.
Clause four
Document required for service- end award disbursement
Article no. 88
In insured is eligible for such award, the following documents are required:-
1- if insured employee quits job at an agency not subject to the effective social insurance law, coverage waiver is required. And if hired again at an agency subject to social insurance laws, a notice shall have to b sent to GASSP.
2- if immigrated abroad , insured's waiver is required and supported by the following:-
- Passport copy singed by country's immigrated to embassy.
- Approval of immigration from immigration country.
- if insured female resigned to look after children, family, or to accompany immigrated husband, resignation shall have to be supported by a waiver that states she shall not work at an agency subject to social insurance laws unless the GASSP is notified.
- if insured's service period is less than the minimum limit of pension eligibility and is referred to retirement due to age, stamped application shall be attached to retirement file.
- if insured employee is sentenced to three years of imprisonment, a stamped copy of verdict is required.
- in all permanently disable, a copy of the designated Medical Committee is required.
Article no. 89
The hiring agency shall have to inform and update GASSP of documents and data of eligible insured employee necessary for pension settlement and definition according to law provisions, and shall be written in Arabic or accredited translation to Arabic language, and approved by the hiring agency. The GASSP undertakes data provided verification inspection.
